Bid Protest, Appeals and 8a Results

Watson & Associates’ Recent Government Cases throughout the United States involving a Wide Variety of Client Issues with Beneficial Case Outcomes

 

2011  – Agency bid protest results in reversle of award. Watson & Associates filed a bid protest with the agency, challenging the award to a company that violated the Buy American Act. After citing favorable case law, the agency reversed the award in our client’s favor.

2011  – Appeal decision of agency to terminate government contractor client in a termination for convenience to the Armed Services Board of Contract Appeals. Given indication from the Court, the agency settled the matter whcih resulted in damages to our client.

2011 – Successful appeal of SBA decision on small business affiliation. Results – Office of Hearing and Appeals overturned SBA decision. See case.

2011 – San Antonio, Texas. Represented a nurse staffing contractor in an 8a termination proceeding before the U.S. Small Business Administration. The termination action was withdrawn. Legal issues addressed included an accusation that the client had submitted false information on an 8() application and failed to disclose an arrest other than a minor motor vehicle violation.

2011 – Fort Worth, Texas. Represented a Caucasian, woman-owned aviation training solutions contractor through the 8(a) application process. The outcome was the achievement of 8a certification. Eligibility issues addressed included the client’s socially disadvantaged status and a waiver of the SBA’s requirement for the client to be in business for two years.

2011- Charleston, West Virginia. Represented an IT contractor in a request for 8a application reconsideration before the U.S. Small Business Administration. The outcome was the achievement of 8a certification. Legal issues addressed included affiliation, the client company’s potential for business success, and control of the client company by a non-disadvantaged entity.

 2010 – Melbourne, Florida. Represented an engineering contractor in an 8a application reconsideration request before the U.S. Small Business Administration. The outcome was the achievement of 8a certification. Legal issues addressed included affiliation, the client company’s potential for enough business success to meet SBA standards for 8(a) certification, and control of the client company by a non-disadvantaged individual.

2010 – Sandy, Utah. Represented an electrical contractor through the 8a application process. The outcome was the achievement of 8a certification. Eligibility issues addressed included recent changes in company ownership and outside business interests of the company owner.

Chicago, Illinois. Represented an electrical contractor through the 8(a) application process. The outcome was the achievement of 8(a) certification. Eligibility issues addressed included the company’s economic dependency, control of the client company by a non-disadvantaged entity, and affiliation issues.

2010 – Encampment, Wyoming. Represented an environmental consulting contractor in an appeal before the U.S. Civilian Board of Contract Appeals. The outcome was a negotiated termination for convenience. Legal issues addressed included conditions surrounding contract obligations and contract novations.

2010 – Fairfax, Virginia. Represented an IT contractor in an appeal before the U.S. Civilian Board of Contract Appeals. The outcomes were a negotiated termination for convenience and a settlement payment in excess of $30 thousand. Legal issues addressed included government delay in payment for client’s contract performance and proof of substantial performance by the prime contractor.

Cary, North Carolina. Represented a construction contractor in a size determination appeal before the U.S. Small Business Administration’s Office of Hearings and Appeals. The outcome was a reversal of SBA’s size determination ruling. Legal issues addressed included the client’s affiliation based on identity of controlling interest and economic dependence.

Waldorf, Maryland. Represented an acquisition management contractor in an 8(a) termination proceeding before the U.S. Small Business Administration. The outcome was withdrawal of the termination action. Legal issues addressed included alleged submission of false information in an 8(a) application and misrepresentation of personal net worth.

San Rafael, California. Defended a service-disabled veteran-owned small business (SDVOSB) cemetery landscaping contractor against a protest filed with the U.S. Department of Veterans Affairs. The outcome was the protest was denied. Legal issues addressed include affiliation and SDVOSBC eligibility criteria

San Antonio, Texas. Defended a construction contractor against a HUBZone protest filed with the U.S. Small Business Administration. The outcome was that the protest was denied. Legal issues addressed included principal office requirements and calculation of number of on-site employees.
