8a Eligibility Requirements
To qualify for the 8a certification program, a small business must be owned and controlled by a socially and economically disadvantaged individual.
Under the Small Business Act, when submitting an 8a certification application, certain individuals are presumed socially disadvantaged: African-Americans, Hispanic Americans, Asian Pacific Americans, Native Americans (American Indians, Eskimos, Aleuts, or Native Hawaiians), and Subcontinent Asian Americans. An individual who is not a member of one of the groups listed can be admitted to the program if he/she shows – through a “preponderance of the evidence” – that he/she is socially disadvantaged. For instance, an individual may show social disadvantage due to race, ethnic origin, gender, physical handicap, long-term residence in an environment isolated from the mainstream of American society; or other similar causes.
In addition, when submitting an 8a certification application, a socially disadvantaged individual must show economic disadvantage by submitting a narrative and personal financial documentation about one’s income, assets, and net worth.
Why consider applying for your 8a certification?
Federal government contracts are not going away any time soon. To combat the hurdles of the current economy, you can utilize the ‘boost’ that the 8a certification program can provide you.
Businesses can rely upon our 8a certification application services:
- To get proper legal analysis: You are not simply approved for the 8a certification program simply because of national origin or social status. The 8a application process is very detailed and regulated. The process requires a careful analysis of ownership status, family ties, net worth and other important issues to which the SBA will look into. New 8(a) Business Development Regulations have been issued.
- To get help with sound narratives. To be admitted, each 8a certification application must persuade the SBA, through a written narrative, that the applicant is economically disadvantaged. Certain national origins are presumed socially disadvantaged and do not have to submit a social narrative.
- To submit requests for reconsideration by the SBA. The SBA has a very high 8a application denial rate. You have one chance to submit a request for reconsideration. Watson & Associates’ 8a consulting team can help you to supplement missing information that could cause your application to be finally approved
- To appeal 8a certification denial. As government contract lawyers, we can submit an appeal to your application denial. Our attorneys will review the reasons for the SBA denial, and if there has been a misapplication of law of reversible error, and then we will appeal to SBAOHA for resolution.
- To fight 8a affiliation allegations.
Get legal representation with 8a terminations
During your tenure as an 8a certified company, the SBA may attempt to terminate you from the program. Never try to handle this process by yourself. Our 8a certification lawyers can respond to the initial 8a termination letter on your behalf. So many applicants attempt to handle this issue on their own. However, they later find out that upon appeal, their rights have been waived simply because they were lacking on the initial termination letter. Our attorneys know how to preserve your rights for appeal.
Before we begin filling out your 8a application a complete assessment of your company is done by us to make sure that you have the highest chance of obtaining your 8a certification. Every aspect of your company which may raise a red flag with the SBA is examined so that you do not waste your money.
